Kilibis Terms and Conditions

  1. Introduction and Acceptance of Terms

1.1. Kilibis is an online digital platform that enables customers to discover and book for services offered by independent service providers.
1.2. By accessing, registering on, or using the Kilibis platform, you agree to be legally bound by these Terms and Conditions.
1.3. If you do not agree with any part of these Terms, you must not use the platform.

  1. Definitions and Interpretation

2.1. “Platform” refers to the Kilibis website, mobile application, and any related digital services.
2.2. “Customer” means any individual or entity that books or intends to book a service through Kilibis.
2.3. “Service Provider” means any independent individual or business that offers services or agrees to offer services through the platform.
2.4. “Booking” means a request by a customer for a service listed on Kilibis.
2.5. “Kilibis”, “we”, “us”, or “our” refers to the owners and operators of the platform.

  1. Nature of the Platform

3.1. Kilibis acts solely as an intermediary connecting customers with independent service providers.
3.2. Kilibis does not itself provide services listed on the platform and is not a party to any service contract formed between customers and service providers.
3.3. Any agreement for the performance of a service is strictly between the customer and the service provider.
3.4. Kilibis doesn’t guarantee that a service provider will accept your booking or a customer would accept your service.

  1. Eligibility, Account Registration and Specific Consent.

4.1. Users must be at least 18 years old to register on the platform.
4.2. All information provided during registration must be accurate, complete, and kept up to date.
4.3. Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out under their account.
4.4. The user consents to the disclosure of specific details—such as age, name, gender, and profile picture—allowing service providers and customers to access this information to foster trust in the service booking process.
4.5. A user’s agreement to utilize any feature within the Kilibis platform suggests implicit familiarity with the feature itself.
4.6 Certain information may be preserved even after account deletion for potential future considerations and reference purposes.

  1. Service Providers’ Obligations

5.1. Service providers represent and warrant that they possess the required skills, licences, permits, and legal authority to offer their services.
5.2. Service providers are solely responsible for the quality, safety, legality, and execution of their services.
5.3. Service providers must provide truthful descriptions, pricing, and availability for their services.

  1. Customers’ Obligations

6.1. Customers agree to provide accurate booking details and to cooperate reasonably with service providers.
6.2. Customers must make payments in accordance with the pricing and payment terms shown at the time of booking.
6.3. Customers are responsible for confirming that a service meets their needs before making a booking.

  1. Bookings and Service Completion

7.1. Service completion may be marked by the service provider, the customer, or automatically by the system in accordance with platform rules.
7.2. Any disputes regarding completion must be raised within the timeframe specified on the platform.
7.3. Kilibis does not review, monitor, or confirm bookings on behalf of customers. The service provider bears full responsibility for properly reviewing all booking details, including the service request, date, time, location, and customer information, before accepting or performing the service. Any failure to review a booking shall be the sole responsibility of the service provider, and Kilibis shall not be liable for errors, misunderstandings, or losses arising from such failure.

  1. Payments, Fees, and Subscriptions

8.1. Payments are processed through third-party payment service providers integrated into Kilibis.
8.2. Kilibis may charge service providers subscription fees, commissions, or other platform fees as disclosed on the platform.
8.3. All fees paid to Kilibis are non-refundable unless expressly stated otherwise.

  1. Cancellations and Refunds
    9.1. Where a user cancels a booking or service on the platform, such cancellation is deemed to be made at the user’s own discretion and responsibility. Once a booking becomes publicly visible or confirmed on the platform, it is automatically counted towards the user’s booking history and usage metrics. Any subsequent cancellation shall not reverse or remove that booking count, and the user accepts that the cancelled booking is forfeited.
    9.2. Refunds, where applicable, are processed by Kilibis within a maximum period of fourteen (14) days on our side. However, the actual time taken for refunded funds to reflect in the user’s account may be longer and is subject to the processing timelines of third-party payment providers, over which Kilibis has no control.
    9.3. Kilibis shall only issue refunds where a user has made payment for a service and did not receive what was paid for solely due to a fault, error, or failure of the Kilibis platform or systems. No refunds shall be issued where non-delivery or loss arises from the user’s own actions, omissions, failure to comply with platform rules, or dealings between the customer and the service provider.
    9.4. Kilibis does not guarantee refunds arising from cancellations and shall not be liable for losses resulting from voluntary cancellations made by users.

  2. Reviews, Ratings, and Feedback

10.1. Customers may leave honest reviews based on genuine experiences.
10.2. Reviews must not be defamatory, misleading, abusive, or unlawful.
10.3. Kilibis reserves the right to remove or moderate reviews that breach these Terms.

  1. Verification and Security

11.1. Kilibis may use email verification, phone verification, or other authentication methods to enhance platform security.
11.2. Verification does not constitute endorsement, certification, or guarantee of any user or service.

  1. Prohibited Conduct

12.1. Users must not misuse the platform, engage in fraud, provide false information, or attempt to bypass platform systems.
12.2. Any unauthorised access, data scraping, or interference with platform functionality is strictly prohibited.

  1. Limitation of Liability

13.1. To the maximum extent permitted by law, Kilibis shall not be liable for any indirect, incidental, or consequential losses.
13.2. Kilibis is not liable for the acts, omissions, negligence, or misconduct of service providers or customers.
13.3. Any liability of Kilibis, where it cannot be excluded, shall be limited to the amount of platform fees paid by the user.

  1. Indemnity

14.1. Users agree to indemnify and hold harmless Kilibis from any claims, damages, or expenses arising from their use of the platform or breach of these Terms.

  1. Suspension and Termination

15.1. Kilibis reserves the right to suspend or terminate accounts that breach these Terms or applicable laws.
15.2. Termination does not affect rights or obligations accrued prior to termination.

  1. Intellectual Property

16.1. All platform content, trademarks, and software are owned by or licensed to Kilibis.
16.2. Users may not copy, modify, or distribute platform content without prior written consent.

  1. Amendments to Terms

17.1. Kilibis may amend these Terms from time to time.
17.2. Continued use of the platform after changes constitutes acceptance of the updated Terms.

  1. Governing Law and Dispute Resolution

18.1. These Terms shall be governed by and construed in accordance with the laws of Ghana.
18.2. Any disputes that arise must initially undergo the platform’s dispute resolution process before pursuing any further legal action.
18.3. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.
